السلطة الوطنية المستقلة للانتخابات في ظل دستور 2020 The Independent National Electoral Authority Under The 2020 Constitution

الملخص
جاء دستور 2020 ليكرس التوجهات الجديدة للدولة الجزائرية خاصة بعد المطالب الشعبية التي جسدها حراك 22 فيفري المبارك و المسيرات المتعاقبة التي استمرت مدة عام و التي من اهم اهدافها بناء دولة ديموقراطية بعيدة عن الممارسات السابقة أساسها دولة القانون و التداول على السلطة ومحاربة الفساد، وقد ظهرت اولى هاته التغييرات بعد انتخاب رئيس جمهورية جديد و الذي كان من بين اولويات برنامجه الانتخابي تجسيد هاته الدولة الجديدة واخلقه الحياة السياسية و الإدارية ومكافحة الفساد وتعزيز الحقوق و الحريات مع ما يترتب عن ذلك من إرساء دعائم الديمقراطية السياسية. حيث جاء دستور 2020 لينص و لأول مرة - في الدساتير الجزائرية منذ الاستقلال في الباب الرابع تحت عنوان مؤسسات الرقابة و في الفصل الثالث - على إنشاء السلطة الوطنية المستقلة للانتخابات ، و التي ضمت 04 مواد من المادة 200 الى المادة 203 من دستور 2020، تتولى هاته الهيئة مهمة التحضير وتنظيم و تسيير الانتخابات وعمليات الاستفتاء، كما صدر في هذا الشأن الامر 21 /01 المؤرخ في 10 مارس 2021 المتضمن القانون العضوي المتعلق بنظام الانتخابات ليكرس فعليا ضمانات استقلالية لهاته السلطة المستقلة. The Constitution of 2020 came to enshrine the new directions of the Algerian state, especially after the popular demands embodied by the blessed February 22 movement and the successive marches that lasted for a year and whose most important goals were to build a democratic state away from previous practices based on the rule of law, the exchange of power and the fight against corruption. The first of these changes came after the election of a new President of the Republic, whose electoral program was among the priorities of his electoral program, the embodiment of this new state, the creation of political and administrative life, the fight against corruption, the promotion of rights and freedoms, with the consequent establishment of the foundations of political democracy. Where the Constitution of 2020 came to provide for the first time - in the Algerian constitutions since independence in Chapter Four under the title of Oversight Institutions and in Chapter Three - the establishment of the Independent National Authority for Elections, which included 04 articles from Article 200 to Article 203 of the 2020 Constitution. The Commission is tasked with preparing, organizing and conducting elections and referendum operations. In this regard, Decree 01/21 of March 10, 2021 was issued containing the organic law related to the electoral system to actually enshrine guarantees of independence for this independent authority.
