الملخص
النظام الانتخابي في الدولة مهما كان عادلا لا يستطيع أن يضمن انتخابات نزيهة ما لم تكن هناك إدارة انتخابية مؤهلة تتولى الاشراف على العملية الانتخابية ،وهذه الادارة تأخذ اشكالا متعددة ولعل الادارة الانتخابية المستقلة والدائمة هي التي تعرف انتشارا في الوقت الحاضر. الجزائر اسوة بالدول التي عرفت اصلاحات انتخابية اعتمدت هذا النوع من الادارة حيث اعتبر المشرع السلطة المستقلة للانتخابات أداة مؤسساتية تشرف وتراقب العملية الانتخابية وعليه سنحاول تقييم الدور الرقابي الدي تقوم به هذه السلطة من خلال النصوص القانونية المنظمة وتجربتها الفتية في الانتخابات الرئاسية مع محاولة التركيز على دورها في تحقيق التوازن بين السلطة المتكونة من الفوز الانتخابي وحقوق الافراد الناشئة بعد الانتخابات، ومن ثم الوقوف عند التحديات التي تواجهها وصولا الى مقومات نجاحها. The electoral system in the country, no matter how fair it is, cannot guarantee fair elections unless there is a qualified electoral administration to supervise the electoral process Algeria, like other countries that went through electoral reforms, adopted this type of administration. The legislator considered the independent authority for elections an institutional tool that supervises and monitors the electoral process Accordingly, we will try to evaluate the oversight role played by this authority through the legal texts regulating and its young experience in the presidential elections, with an attempt to focus on its role in achieving a balance between the authority consisting of electoral victory and the rights of individuals arising after the elections, and then standing at the challenges it faces in order to reach the ingredients for its success.
