تعدد وسائل الرقابة على جرائم الفساد...أية فعالية

الملخص
تناولت هذه الدراسة مسألة هامة وحيوية بالنسبة لكل دولة وهي تعدد الأجهزة المكلفة بمكافحة الفساد الإداري والمالي، ولذلك وجب التفكير في خلق حماية فعالة تضمن حسن سير المرافق العامة ، فجرائم الفساد تؤثر على الأداء المالي والإداري، وتتسبب في إهدار المال العام وتعطيل الدولة عن مباشرة أعمالها أو وظائفها المختلفة، وهو ما يؤثر على مصلحة الفرد والمجتمع. ولقد أشرنا إلى أن هذا التعدد في وسائل الرقابة على جرائم الفساد الذي جاء متماشيا مع الالتزامات الدولية والإقليمية للدولة الجزائرية في هذا المجال أمر إيجابي وفعال من الناحية النظرية فقط، أما واقعيا وعمليا فالتعدد المشار إليه يحد من فعالية الرقابة على الفساد. This study dealt with an important and vital issue for each country, which is the multiplicity of agencies charged with combating administrative and financial corruption. Therefore, it is necessary to think about creating effective protection to ensure the proper functioning of public utilities. Corruption crimes affect the financial and administrative performance, and cause the waste of public money and obstruction of the state from conducting its business or Its various functions, which affect the interest of the individual and society. We have pointed out that this multiplicity of means of controlling corruption crimes, which came in line with the international and regional obligations of the Algerian state in this field, is positive and effective in theory only, but in reality and in practice, the aforementioned multiplicity limits the effectiveness of controlling corruption.
