الطابع الوقائي للتشريع البيئي

الملخص
يحتل موضوع حماية البيئة أهمية كبيرة وهو يشكل أحد أخطر القضايا في العصر الحديث لتعلقها بمستقبل البشرية ككل. وتضافرت جهود المجتمع الدولي في إيجاد السبل الكفيلة لحماية البيئة بعناصرها المختلفة، وتوصلت في هذا الإطار إلى عقد العديد من المؤتمرات وتبني العديد من المبادىء في هذا الشأن لإضفاء الحماية اللازمة، واتخاذ الإجراءات والتدابير الكفيلة بتحقيق هذا الهدف، وذلك بتبني وتفعيل مبدأ الوقاية لمنع وقوع الأضرار البيئية. وتناولت هذه الورقة البحثية بالدراسة والتحليل للطابع الوقائي للتشريع البيئي مبينة تجسيد هذا المبدأ الهام من طرف التشريع البيئي في الجزائر وخاصة القانون03-10 الذي يتعلق بحماية البيئة في إطار التنمية المستدامة، كما تناولت أيضا الصعوبات التي تعترض تفعيل الطابع الوقائي للتشريع البيئي. The issue of environmental protection is of great importance and constitutes one of the most serious issues in the modern era as it relates to the future of humanity as a whole. The efforts of the international community have combined to find ways to protect the environment with its various elements, and in this context, it has held many conferences and adopted many principles in this regard to give the necessary protection, and take measures and measures to achieve this goal, by adopting and activating the principle of prevention to prevent environmental damage. This research paper dealt with the study and analysis of the preventive nature of environmental legislation, indicating the embodiment of this important principle by environmental legislation in Algeria, especially Law 03-10, which is related to the protection of the environment in the framework of sustainable development.
