مبدأ عدم توقيع الجزاءات على اللاجئ كضمانة للحماية

الملخص
انطلقت الجهود الدولية لحماية اللاجئين في النصف الأول من القرن العشرين بفضل عصبة الأمم، غير أنّ انهيارها أوقف تلك الجهود لغاية قيام منظمة الأمم المتحدة التي وافقت الجمعية العامة التابعة لها على ابرام اتفاقية خاصة بوضع اللاجئين في 25 جويلية 1951، حيث توضح الاتفاقية الأشخاص المتمتعين بوضع اللاجئ والحماية الممنوحة لهم، وتفرض على الدول الموقعة عليها واجب الامتناع عن فرض أي نوع من العقوبات جزائية كانت أم إدارية على اللاجئين بسبب دخولهم إلى حدودها الإقليمية، أو بسبب وجودهم غير القانوني على أراضيها، والذين يدخلون إقليمها أو يوجدون فيه دون إذن، قادمين مباشرة من إقليم كانت فيه حياتهم أو حريتهم مهددة بالمعنى المقصود في المادة الأولى من الاتفاقية ، شريطة أن يقدموا أنفسهم إلى السلطات دون إبطاء وأن يبرهنوا على وجاهة أسباب دخولهم أو وجودهم غير القانوني. International efforts to protect refugees were launched in the first half of the twentieth century through the efforts of the League of Nations, but their suspension halted these efforts until the United Nations, whose General Assembly approved the conclusion of a special agreement on the status of refugees on July 25, 1951, where the convention clarifies persons with status Refugees and the protection granted to them, and the signatory states have a duty to refrain from imposing any kind of penal or administrative penalties on refugees because of their entry to its territorial borders, or because of their illegal presence on their lands, and those who enter or are in their territory without permission, coming directly from A territory in which their lives or freedom were threatened within the meaning of Article 1 of the Convention, provided that they present themselves to the authorities without delay and that they prove the validity of the reasons for their illegal entry or presence.
