الملخص
يعتبر موضوع الاخبار الكاذبة أحد المشكلات التي استفحلت في هذا العصر، خاصة مع ظهور أزمة كورونا 19 مما فتح المجال لانتشارها بشكل كبير خاصة مع التطور التكنولوجي وتوفر آليات الاتصال الرقمي. و تعتبر الجزائر كغيرها من الدول معرضة لكم هائل من الاخبار الكاذبة حول واقع فيروس كورونا في البلاد و ازداد الوضع تأزما نتيجة غياب وجود تشريع وطني يعاقب على الجرائم التي ترتكب خلال الأزمات، لهذا سنحاول من خلال هذا المقال معرفة مكانة الاخبار الكاذبة في القانون العضوي للإعلام والقانون السمعي البصري و قانون العقوبات ومدى مسايرتها للأخبار الكاذبة حول فيروس كورونا المستجد. و سنعتمد في ذلك على المنهج الوصفي الذي يهتم بالمشكلات الانية كما سنستخدم الملاحظة و مختلف الوثائق والدراسات المتوفرة في هذا المجال كأدوات لجمع البيانات. من اهم النتائج المتوصل اليها ضرورة تحيين قوانين الاعلام و قانون العقوبات وفقا لمتطلبات العصر و كذا التطبيق الصارم لها و ضرورة الاهتمام بأخلاقيات المهنة و خاصة التربية الاعلامية الرقمية. The subject of false news is one of the problems that has been exacerbated in this era, especially with the emergence of the Covid19 crisis, which has opened the way for its spread, with technological development and the availability of digital communication mechanisms. Algeria, like other countries, is exposed to a huge amount of false news about the coronavirus, so we will try through this article to find out the place of false news in the organic law of media, audiovisual law and penal code. We will use the descriptive approach to the problems of the ego and will use the observation and the studies available in this field. One of important results is the need to update the media laws and penal code in accordance time, as well as the strict application of them and the need to pay attention to professional ethics, especially digital media education. Les fausses infos est un problème qui s’est aggravé avec l’émergence de la crise du covid19 favorisant sa propagation avec l’aide de la technologie numérique. L’Algérie est exposée à une énorme quantité de fausses informations sur le coronavirus, la situation s’est compliquée en raison de l’absence d’une législation nationale punissant les crimes commis en crises. Nous essayerons à travers cet article de trouver la place des fausses infos dans la loi organique sur l’Information et le code pénal, et à quelle mesure ces textes les traitent en situation de pandémie. Nous utiliserons, pour cela, l’approche descriptive ainsi que l’observation, appuyée par divers documents et études comme outils de collecte de données. L’un des résultats à noter est la nécessité d’adapter les lois sur l’information et le code pénal aux exigences actuelles et leur application, et de mettre l’accent sur l’éthique de la profession et l’éducation sur l’information numérique.
