نظام ملكية الأرض في المغرب الأوسط خلال العهد الزياني بين التنظير الفقهي والواقع التاريخي- أراضي الإقطاع والظهير السلطاني *أنموذجا*-

الملخص
الملخص: تشكل قضايا الأرض في المغرب الأوسط خلال العهد الزياني إحدى المفاتيح الأساسية لفهم النشاط الزراعي. ويعتبر الإقطاع أحد أهم القضايا الأساسية في نظام ملكية الأرض، ونلاحظ ذلك جليا من خلال كثافة الفتاوى والنوازل والنزاعات التي عرضت على الفقهاء بغرض معالجتها والفصل فيها. وملكية الأرض في المغرب الأوسط شهدت تنوعا في مسألة التملك والحيازة، وتنوعا أيضا في أشكال وطرق الاستغلال. هذا وقد شكلت أراضي الإقطاع والظهير السلطاني دورا مهما في استئلاف وتقريب بعض الفئات من السلطة الزيانية، فقد قام معظم سلاطين الدولة بإقطاع الكثير من الأراضي لصالح القبائل والشخصيات ورجال السلطة من قادة وجنود. نهدف من خلال الورقة البحثية إلى معرفة وضعية نظام ملكية الأراضي في المغرب الأوسط الزياني، مركزين على أراضي الإقطاع، ثم مقارنة هذا النوع من الأراضي بين ما هو مقرر في النصوص الفقهية وبين الواقع التاريخي وسياسة الدولة آنذاك. :ABSTRACT Land issues in the Maghreb during the Zayani era are one of the primary keys to understanding agricultural activity. Feudalism is one of the most fundamental issues in the land ownership system, and we notice this clearly through the intensity of fatwas, calamities and disputes that were presented to jurists for the purpose of handling and adjudicating them. Land ownership in the Maghreb saw a diversity in the issue of ownership and possession, as well as a variety of forms and methods of exploitation. The lands of feudalism and the royal back have played an important role in the resumption and approximation of some groups of the Zayani authority, as most of the sultans of the state cut off a lot of lands for the benefit of tribes, personalities and men of authority, including leaders and soldiers. We aim through the research paper to know the status of the land ownership system in Zayani Central Morocco, concentrated on feudal lands, and then compare this type of land between what is decided in jurisprudential texts and the historical reality and state policy at the time.
