سلطات الضبط الاقتصادي، رؤية جديدة لوظيفة الدولة

الملخص
بعد تبني الجزائر لاقتصاد السوق في دستور 1989 تم فتح الباب أمام الخواص للقيام بالنشاطات الاقتصادية التي كانت تحتكرها الدولة، وما ترتب على هذا النظام الاقتصادي الجديد ظهور ضرورة ضبط المنافسة بين المتعاملين الاقتصاديين العموميين والخواص،واقتضت قواعد الشفافية والحياد إسناد القيام بهذه المهمة لسلطات مستقلة عن الدولة، وذلك لأنه لا يمكن أن نتصور أن يكون للدولة في هذا النظام الاقتصادي الجديد دورين في آن واحد، دور كمتعامل اقتصادي باعتبارها كمساهم في المؤسسات العمومية الاقتصادية، ودورها كمكلفة بوضع القواعد التنافسية. أي كان لابد من الفصل بين مهامها في استغلال المؤسسات العمومية الاقتصادية ومهامها في الضبط الاقتصادي، هذه الأخيرة التي تم إسنادها لسلطات الضبط الاقتصادي التي اعتبر إنشاؤها إعلانا عن تغير وظيفة الدولة. الكلمات المفتاحية: سلطات الضبط الاقتصادي، السلطات الإدارية المستقلة، الدولة الضابطة، النظام العام الاقتصادي. Abstract: When Algeria adopted the market economy in the 1989 Constitution, the door was opened for private individuals to carry out economic activities that had been monopolized by the state. This new economic system resulted in the necessity of controlling competition between public and private economic operators. The rules of transparency and impartiality required the assignment of this task to authorities independent of the state. This is because we cannot imagine that the state in this new economic system should have two roles at the same time, as an economic agent as a contributor to public economic institutions, and its role as a competitor in setting competitive rules. It was necessary to separate between the state functions in the exploitation of public economic institutions and its functions in regulating the economy. This approach in assigning the regulation of the economy to an independent authority of economic control was considered as a declaration of changing the function of the state.
