اشتغال المصطلح اللّساني التّداولي في الخطاب القانوني الجزائري

الملخص
تهدف الدّراسة إلى الكشف عن أهمية المصطلح التداولي في الخطاب وكيفية توظيفه واشتغاله في هذا المنحى، باعتباره من المباحث اللّغوية حديثة النشأة، والرّائدة بمحتواها ومضمونها البحثي القيّم في حقل الدّراسات اللّغوية المعاصرة، وقد اخترت الخطاب القانوني الجزائري باعتباره من الخطابات التي لم تحظى بكم وافر من الدّراسات، وهذا راجع إلى طبيعة هذا النوع من الخطابات التي لها مميزات خاصة تنفرد بها عن بقية أنواع الخطاب الأخرى، كذلك نسعى إلى التطرق إلى طبيعة المصطلح اللّغوي القانوني، وجانبه الاستعمالي الذي تمثله الدّراسة التداولية، حيث تهتم هذه الأخيرة بدراسة اللّغة في جانبها الوظيفي والاستعمالي، وهذا باعتبار السّياق ومقتضى الحال والمقام التواصلي، وهذا باعتماد المباحث التداولية المعروفة من أفعال كلامية وحجاج وإشاريات وافتراضات ومسبقة وغيرها. The study aims to reveal the importance of the pragmatic term in discourse and how to employ it and function in this regard, as it is one of the newly emerging linguistic topics, and a pioneer with its content and valuable research content in the field of contemporary linguistic studies. I chose the Algerian legal discourse as it is one of the discourses that has not received a large amount of studies. This is due to the nature of this type of discourse, which has special characteristics that distinguish it from the rest of the other types of discourse. We also seek to address the nature of the legal linguistic term, and its usage aspect, which is represented by pragmatic study, as the latter is concerned with studying language in its functional and usage aspect, and this Taking into account the context, the exigencies of the situation, and the communicative position, and this is by adopting the well-known pragmatic topics of speech acts, arguments, indicative, presuppositions, priors, and others.
