مسؤولية مبرمج الوكيل الإلكتروني و أثرها في حماية المستهلك الالكتروني

الملخص
يلعب الوكيل الإلكتروني دورا هاما في مجال تسيير المعاملات التجارية الإلكترونية، إذ أنه يساعد الأفراد على إبرام عقود الاستهلاك الإلكترونية، فهو يمثل حلقة وصل بين المورد و المستهلك الإلكتروني، فالوكيل الإلكتروني هو برنامج كومبيوتر يتمتع بالذكاء و القدرة على التفاعل، مهمته الأساسية الترويج و عمل الدعاية اللازمة للسلعة أو المنتج محل عقد الاستهلاك الإلكتروني و البحث عن العملاء و تشجيعهم على التعاقد مع الموكل الذي برمج الوكيل الإلكتروني، كما يقوم بالتعاقد مباشرة مع المستهلك الذي يرغب في الشراء فيبين له شروط و بنود التعاقد و أوصاف محله و كل المعلومات المتعلقة بالعرض الإلكتروني المقدّم. مما لا شك فيه أن مسؤولية مبرمج الوكيل الإلكتروني من أهم المسائل التي تتعلق بالوكالة التجارية و حماية المستهلك المتعاقد في ظل بيئة إلكترونية من النفوذ الاقتصادي و الفني لمبرمجي الوكيل الإلكتروني المحترفين، و بالتالي يتم مساءلة مبرمج الوكيل الالكتروني مدنيا و جنائيا عن إخلاله بقاعدة من قواعد السلوك و كذا عند خرقه للالتزامات المقررة عليه قانونا.
