الملخص
الملخص : اهتمت التشريعات الدولية والوطنية بحماية حقوق الإنسان مكرسة إياها في مختلف القوانين والاتفاقيات الدولية، مقرة بحقوق متساوية وثابتة لجميع أفراد المجتمع عن طريق توفير ضمانات تصون حقوقهم، حيث تعتبر فئة الأشخاص ذوي الاحتياجات الخاصة من بين فئات المجتمع التي يستوجب أن تلقى حماية خاصة لهم نظرا لما تعانيه من نقص يشوب ملكاتهم العقلية أوالحركية، ومهما كانت درجة الإعاقة وسببها التي يعاني منها الشخص المعاق،كرست الاتفاقية الدولية الصادرة بقرار الجمعية العامة في 13 ديسمبر 2006 التي تضمنت حماية من نوع خاص لفئة خاصة في المجتمع والتي صادقت عليها الجزائر في 12 ماي 2009 معززة حمايتهم بتشريعات وطنية مصدرة القانون رقم 09-02 المؤرخ في 08 ماي 2002 المتعلق بحماية الأشخاص المعاقين وترقيتهم، مما يدل على اعترافها بهذه الفئة والرغبة في تعزيز حقوقها مراعاة لعجزهم ومن أجل تمكينهم من المشاركة في المجتمع عملا بمبدأ المساواة بين أفراده دون تمييز. . Abstract: The International and national législation have dévote attention to the protection of humain right; enchrined in various international Law and conventions; affirming equal right and guarantees for all members of society by providing guarantees for the protection of Thiers right. Be cause of the lack of mental or Motors disabilities; regardless of the degré of disability and the cause suffred by the disabled Person in réponse to what was enchired in the international convention issued by the General assemblé résolution on 13 décembre 2006; which included spécial protection for a spécial catégory in the community where It ratified Alegria on 12 May 2009; renforce by national législation promulgated bu Law no. 09-02 of 08 May 2002 on the protection and promotion of pesons with disabilities; which indiçâtes its récognition of This catégory and the désire to protome Thiers right in view of Thiers disability and to enable thème to participâtes in society in accordance with the principale of qualité among its members Without discrimination.
