تكييف العقوبات السالبة للحرية كآلية لترشيد نفقات المؤسسات العقابية Alternatives Sanctions Deprivation Of Liberty As A Mechanism To Rationalize Expenses Of The Prison Establishments

الملخص
الملخص: يهدف هذا البحث، إلى تسليط الضوء على بدائل للعقوبة السالبة لحرية المحبوس حسن السيرة والسلوك، وكذا تسليط الضوء على بدائل لعقوبة المحبوس المدان بعقوبة سالبة للحرية لمدة قانونية معينة، وهذا من أجل المساهمة في التقليل من الأغلفة المالية التي تخصص من ميزانية الدولة لتغطية نفقات المؤسسات العقابية. توصلنا في الأخير إلى أن نظام إجازة الخروج يساهم قليلا إلى حد ما في ترشيد هذه النفقات، أما نظام التوقيف المؤقت لتنفيذ العقوبة ليس له أثر في ذلك، في حين كلا من نظام الإفراج المشروط ونظام الوضع تحت المراقبة الإلكترونية، يساهمان كثيرا في ترشيد هذه النفقات، ولهما آثار إيجابية معتبرة. Abstract: This research aims to study alternatives sanctions deprivation of liberty of a detainee has a good conduct and behaviour, as well to study alternatives sanctions of a detainee has convicted by a deprivation of liberty for a certain legal period. In order to contribute on minimization of financial expenses from the State budget to cover the expenses of prison establishments. In the end, we concluded that the exit permit system contribute little on the minimization of financial expenses. The system of temporary suspension for the execution of the sanction has not effect on that. The conditional liberation system and the electronic control system, contribute on the minimization of financial expenses.
