الملخص
الملخص: الملخص: تعد مؤسسات الأوقاف والزكاة أهم مؤسسات العمل الخيري التطوعي في الاقتصاد الاسلامي، حيث تقوم بمشاريع وأنشطة تساهم في تحقيق الأبعاد الاقتصادية والاجتماعية والبيئية. إن الوقف باعتباره قطاع تضامني ، أضحى يحقق العديد من المزايا ،ذلك بما يوفره من خدمات اجتماعية كثيرة، وبتمويله لشبكة واسعة من المؤسسات الخدماتية، في مجالات عدة كالتعليم والصحة وفي كثير من المنافع العامة. لقد استطاع الوقف بمؤسساته المشاركة بفعالية في تحقيق التكافل الاجتماعي و محاربة الفقر وإنعاش سوق العمل. على الرغم من الاتفاق على مشروعية حكمه، غير أن فقهاء الشريعة الإسلامية تضاربت آرائهم حول تقسيمات الوقف ،سواء من حيث أجل الانتفاع به،أو بحسب نوع الأموال الموقوفة. جاءت هذه الدراسة بغرض سرد آراء كل مذهب حول صيغة الوقف عموما ، ووقف النقود خصوصا ،و التمحيص في أدلتهم من الوجهة الشرعية والقانونية، و التنظير في مصلحة تطبيقاتها في ظل العولمة وتكنولوجيات العصر. وهل الوقف يضمن مصلحة الوقف والموقوف عليه فقط، أم أنه يحقق حتى المصلحة العامة للمجتمع.؟ وهل الوقف يناسب الظروف التي يعيشها والأحوال التي يحياها الناس بعدما توسعت مجالاته وشملت كافة جوانب البر والإحسان.؟ اعتمدت الورقة البحثية على المنهج التحليلي من خلال استظهار آراء الفقهاء القدامى و المعاصرين على السواء حول صيغة الوقف في الفكر الاسلامي والقانوني. توصلت هذه الدراسة الى أنه لم يقل أحد من المذاهب الأربعة بجواز تأقيت الوقف، وأنه يجوز وقف النقود للقرض الحسن وللاستثمار،بدليل مشاركة عدد معتبر من الواقفين في صندوق واحد بغرض إصدار أسهم نقدية، تشجيعاوتحفيزا للاستثمار في الوقف. واذ توصي بتجسيد سنة الوقف بشكل عام ،ووقف النقود كإحدى الوسائل الفعالة في التنمية المستدامة بشكل خاص. الكلمات المفتاحية: الوقف-المؤبد-المؤقت- الصيغة-النقود. Abstract: Awqaf institutions are the most important voluntary charitable work in the Islamic economy.It carries out projects that contribute to achieving the economic, social and environmental dimensions. The endowment, is now achieving many benefits, by providing many social services, for a wide network of service institutions, such as education, health, and other public benefits. It has managed to stop its institutions actively participating in achieving social solidarity, fighting poverty and reviving the labor market. Despite agreeing on the legality of his rule, however, Islamic jurisprudence jurists have contradicted their views on the divisions of the waqf, whether according to the time to use it, or according to the type of funds held The endowment, as solidarity sector, has achieved many benefits, by providing it with social services and funding it for a wide network of service institutions, and in many fields such as education, health.. It has managed to stop its institutions actively in achieving social solidarity, fighting poverty and reviving the labor market. Despite agreeing on the legality of his rule, however, Islamic jurisprudence jurists have contradicted their opinions on the divisions of the endowment, whether according to the time to use it, or to the type of funds held. This study came with the purpose of presenting the opinions of each doctrine about the endowment formula in general, and stopping money in particular, while examining their evidence from the legal and legal point of view, in light of globalization and modern technologies. Does the endowment guarantee only the interests of the endowment and those arrested, or does it even fulfill the general interest of society.? Is the endowment appropriate to the circumstances in which it lives and the conditions that people live, after covering all aspects of righteousness and charity? The research paper relied on the analytical method by exploring the opinions of both ancient and contemporary jurists on the endowment formula. This study concluded that none of the four schools of thought said that it is permissible to waqf waqf, and that money may be suspended for a good loan and for investment, through the participation of a number of those standing in one fund and the issuance of cash shares to encourage endowment and to achieve collective participation in it. And recommending the embodiment of the endowment year in general, and the endowment of money as one of the effective means in sustainable development in particular. key words: Waqf - life - temporary - formula – money
