الملخص
الملخص: على الرغم من أن الصناعة المالية الإسلامية عرفت تطورات هامة سواء على المستوى التشريعي و المالي الإسلامي أو على مستوى الانتشار الجغرافي ،غير أن الهيئات المصرفية في الجزائر لم تتبنى بعد إطارا قانونيا واضحا، يلائم طبيعتها وخصائصها الشرعية. تقوم إشكالية هذا البحث حول واقع الصناعة المالية الإسلامية في الجزائر، وما هي البيئة القانونية الملائمة لنشاط هذه المؤسسات، ومدى رواج منتجاتها ، مع الوقوف عند أهم العوائق التي تعيق تطورها ونموها المحلي. تهدف هذه الدراسة إلى التطرق إلى أهم المتطلبات الواجب توفيرها كحد أدنى لتشجيع وتطوير الصيرفة الإسلامية في الجزائر، التي ما تزال بعيدة عن ماهو مطلوب ،والاضطلاع أيضا على مختلف النشاطات التي حققتها الصناعة الإسلامية في الجزائر، وما هي أهم القوانين التي صدرت لتقنين هذه المعاملات . أما منهج هذه الدراسة فهو منهج وصفي يقوم على جمع المعلومات المتصلة بتطورات الصناعة المالية الإسلامية بمختلف مؤسساتها ومؤشراتها ،بغية عرضها في إطار أهداف البحث وفي حدود اشكاليته. الكلمات المفتاحية: الصناعة المالية الإسلامية، واقع واستراتيجيات ، معوقات التطبيق،الجزائر. Abstract: Although the Islamic financial industry has witnessed significant developments both at the legislative and Islamic levels as well as at the level of geographical spread, the banking authorities in Algeria have not yet adopted a clear legal framework that suits their legal nature and characteristics. The problem of this research is based on the reality of the Islamic financial industry in Algeria, and what is the appropriate legal environment for the activity of these institutions, and the popularity of their products, while identifying the most important obstacles that hinder their development and local growth. This study aims to address the most important requirements to meet as a minimum to develop Islamic banking in Algeria, which is still far from what is required, and also to review the various activities achieved by the Islamic industry in Algeria, and what are the most important laws issued to codify these transactions. The methodology of this study is a descriptive approach based on gathering information related to the developments of the Islamic financial industry in its various institutions and indicators, in order to present them within the framework of the research objectives and within the limits of its forms.
