الملخص
الملخص: لقد تعرضت المقدسات والشعائر الإسلامية منذ القدم لإعتداءات وإنتهاكات بالرغم من ظهور بوادر حمايتها في تلك الحقب الزمنية، خاصة بعد ظهور الديانات السماوية التي كان لها الأثر البارز في تطور قواعد حمايتها، خلال القرن العشرين وأوائل القرن الواحد والعشرين . حيث أقرت لها حماية لتجريم كل فعل من شأنه المساس بها ،ومعرفة هذه الحماية يستلزم _بطبيعة الحال_البحث في مدى إلمام الفقهاء بالموضوعات المتعلقة بالمقدسات الدينية، سواء من حيث وضع تجريم يكفل حسن حمايتها، أو وضع القيود التي تضمن عدم المساس بها، والإطلاع على ما توصل إليه القانون الوضعي في هذا المجال مقارنة بالفقه الإسلامي. Abstract: The Islamic holy places and rites have been subjected to attacks and violations since time immemorial, despite the appearance of signs of protection in these times, especially after the emergence of divine religions, which had a prominent impact on the evolution of the rules for their protection during the twentieth and early twenty-first centuries. has recognized the protection of the criminalization of any act that may prejudice it. Knowing this protection requires the situation, to examine the extent to which scholars are familiar with the topics of religious sanctity, whether in terms of establishing an offence that guarantees their proper protection, or establishing restrictions that ensure that they are not compromised, and to learn about the findings of positive law in this area as compared to Islamic jurisprudence
