الملخص
يعتبر التفاوض ثنائي الأطراف آلية لتحقيق الاستقرار و السلم الاجتماعي داخل المؤسسات الاقتصاديــــــة، و ازدادت أهميته، خاصة في ظل انتقال الجزائر من النظام اللائحي إلى النظام التعاقدي، عندما فتح المشرع المجال أمام الشركاء الاجتماعيين من اجل تنظيم علاقاتهم على أساس التفاوض و التشــــــــــــــــــــــــــاور و الحوار، في ظل انسحاب الدولة و اكتفائها بوضع حد أدنى من القواعد التي تضمن لها احترام النظام العام الاجتماعي، و ترك الباقي للتفاوض حوله حسب خصوصية نشاط كل مؤسســة من المؤسسات الاقتصادية. Bilateral negotiations are considered as a mechanism for achieving stability and social peace within economic institutions. This is especially important in light of the transition of Algeria from the regulatory system to the contractual system, when the legislator opened the door for social partners to organize their relations on the basis of negotiation, consultation and dialogue. The withdrawal of the state and its enforcement by establishing a minimum of rules to ensure respect for public social order, leaving the rest to negotiate around the specific activity of each economic institution.
