الإبادة الثقافية في صورة جريمة إبعاد الاطفال قسرا

الملخص
جريمة الإبادة الجماعية في صورة نقل أطفال الجماعة عنوة إلى جماعة أخرى من أخطر الجرائم التي ترتكب على الأطفال، لأنها تهدف إلى طمس هوية الأطفال وتغيير انتمائهم ومعتقداتهم، وتتحقق عند استهداف الأطفال الذين لا تتجاوز أعمارهم 18 سنة والمنتمين إلى جماعة قومية أو دينية أو عرقية أو إثنية وإبعادهم قسرا عن جماعتهم الأصلية ونقلهم إلى جماعة أخرى تختلف في الدين واللغة والثقافة عن جماعتهم وهو ما يشكل جريمة إبادة ثقافية. حيث أن هذا الفعل يعد جريمة دولية معاقب عليها بموجب اتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها لعام 1948، كما تم تجريمه في الأنظمة الأساسية للمحاكم الجنائية المؤقتة، وكذا في النظام الأساسي للمحكمة الجنائية الدولية وتقرير عقوبات عليه، إلا أنه ورغم صدور اتفاقية منع جريمة الإبادة الجماعية منذ 1948 ومحاكمة مجرمي الحرب ومرتكبي أفعال الإبادة في المحاكم الجنائية الدولية المؤقتة، إلا أن هاته الجريمة لازالت ترتكب على الأطفال ولم تحقق لهم الحماية من تعرضهم لها. The crime of genocide in the form of forcibly transferring the children of the group to another group is one of the most serious crimes committed againt children because itaims to obliterate the identity of children and change their affiliatiation and beliefs theirorginal group and transferring them to another group that differs in religion, language and culture forom their group, which includes the crime of cultural genocide as this act is an international crime punishable under the 1948 convention of the prevention and peinishent of the genocide and punishment of the crime of genocide and its criminaliwation in the st atutes of the kenporay creinnal,as well as in the rtatute of the interin criminal courts, as well as in the statute of the statute of the internal court and the report of penaltees for it but despite the issance of the couvention the prevention of the crime of genocide since 1948 prosecting war criminals and perpetrators of genocide in temporary international tribunals, this crime is still committed on cheldren were not protected from expoure to it.
