رخصة البناء وعلاقتها بحماية المجال الطبيعي في التشريع الجزائري

الملخص
سعت الجزائر إلى تعزيز الإطار القانوني المؤسساتي بوضع سياسة بيئية شاملة، وذلك من خلال خلق آليات قانونية تبرز من خلالها سلطات الضبط الإداري في حماية البيئة، ودور الإدارة في ذلك على المستويين الوطني والمحلي. ومن بين هذه الآليات نجد دور قواعد التهيئة والتعمير في حماية البيئة، والتي تشتمل على ضرورة الحصول على التراخيص العمرانية والشهادات الإدارية لرقابة عملية التهيئة والتعمير وعلى رأسها رخصة البناء. Algeria sought to strengthen the institutional legal framework by setting a comprehensive environmental policy, by creating legal mechanisms through which the administrative control authorities in protecting the environment, and the role of the administration in this, at the national and local levels, emerge. Among these mechanisms, we find the role of the planning and reconstruction rules in protecting the environment, which include the need to obtain urban permits and administrative certificates to monitor the planning and reconstruction process, especially the building permit.
