تحديد شرط جدية الدفع ودوره في تفعيل الرقابة البعدية على دستورية القوانين وفق آلية الدفع بعدم الدستورية

الملخص
تعد آلية الدفع بعدم دستورية القوانين المحرك الرئيسي التي عززت العلاقة بين القضاء والمجلس الدستوري ،فبإستقراء مواد القانون العضوي المنظم لهذه الآلية رقم 18-16 نجد أن شرط الجدية يلعب دورا محوريا في بعث الفعَّالية لهذا النوع من الرقابة بكبح الدفوع الكيدية التي من شأنها إغراق المجلس الدستوري وتعطيل القضاء المثار أمامه الدفع ومن جهة أخرى تحقيق سمو الدستور وإقرار الدولة القانونية التي يعلو فيها صوت القانون . Abstract: The mechanism for advancing the unconstitutionality of laws is the main driver that strengthened the relationship between the judiciary and the Constitutional Council. By extrapolating the articles of the organic law regulating this mechanism No. 18-16, we find that the condition of seriousness plays a pivotal role in resuming the effectiveness of this type of control by curbing malicious defenses that would dump the Constitutional Council And the obstruction of the judiciary that is being pushed before him, and on the other hand, the achievement of the supremacy of the constitution and the establishment of the legal state in which the voice of the law is raised.
