Abstract

اصبحت ظاهرة توجيه العقد، وتدخل المشرع في انشاءه و في المنع من الانعقاد و في التنفيذ تتزايد بكثرة، في حين الدور الذي تلعبه الإرادة يتناقص تدريجيا، و تتغلب النزعة الاجتماعية على الفردية . الكلمات المفتاحية : التوازن العقدي ، الالزام و المنع ، الحرية التعاقدية ،التوجيه. Abstract: The contract has become closely associated with the phenomenon of guidance. As the legislator interferes in its establishment, its restraint from conclusion, its implementation. Whereas the role played by the will is gradually decreasing. Therefore, the contractual nature of the contract weakens and social tendency prevails over individualism.
