نظام الافراج المشروط في التشريع الجزائري (دراسة تحليلية في ظل القانون 05/04)

الملخص
تَسْعى المنظومة العقابية الجديدة في الجزائر الى إِعتماد اساليب بديلة للعقوبة السالبة للحرية تقوم على اصلاح المحبوسين وتأهيلهم لإعادة إِدماجهم في المجتمع، ويسمح نظام الافراج المشروط للمحكوم عليه بقضاء جزء من عقوبته خارج اسوار المؤسسة العقابية، بشرط ان يتسم سلوكه بالاستقامة اثناء وضعه تحت المراقبة والاختبار، ولا يعتبر الافراج المشروط حقاً للمحكوم علية بل مجرد منحة او مُكافأة له، إِعْتَبرهُ البعض تدبير مستقل للتأهيل الاجتماعي او مرحلة من مراحل تنفيذ العقوبة السالبة للحرية، والاستفادة منه مقترنة بتوفر الشروط الشكلية والموضوعية المطلوبة قانونا، وتترتب عنه مجموعة من الاثار القانونية السابقة واللاحقة لمدة العقوبة، كتقديم مساعدات مالية للمفرج عنه ورعايته، مع امكانية الغاء مقرر الافراج . وتهدف هذه الدراسة؛ الى ابراز المكانة التي يحتلها نظام الافراج المشروط ضمن التعديلات العقابية الجديدة التي اقرها القانون 05/04، في الجزائر وبيان شروطه، واثاره القانونية، ويعتبر نظام الافراج المشروط احد البدائل للتخفيف من ظاهرة تكديس المحبوسين داخل المؤسسات العقابية، وتشجيعهم على تحسين سلوكهم والتزام الاستقامة للاستفادة من هذا النظام. Abstract: The new penal system in Algeria seeks to adopt alternative methods of punishment that deprives of liberty based on reforming the prisoners and rehabilitating them for their reintegration into society and the conditional release system allows the convict to spend part of the his punishment outside the walls of the penal institution provided that his behavior is straightforward during his probation ; and conditional release is not considered a right of the convict, but rather a mere grant or reward for him. The formal and substantive conditions required by law which entail a set of legal consequences prior and subsequent to the sentence period such as providing financial aid to the released person and taking care of him with the possibility of canceling the release decision. This study aims to highlight the position occupied by the conditional release system within the new punitive amendments approved by Law 05/04 in Algeria and to clarify its conditions and legal effects, the conditional release system is considered as one of the alternatives to reduce the accumulation of prisoners inside the penal institutions and encourage them to improve their behavior and adhere to integrity to benifit from this system
