دور التصديق الإلكتروني في إثبات المعاملات الإلكترونية وحفظها

الملخص
تعتبر مرحلة التصديق على التوقيع الإلكتروني أهم المراحل في إبرام المعاملات الإلكترونية بمختلف أنواعها، وذلك لما لهذه المرحلة من دور بارز في انعقاد العقد والتأكد من صحة ما ورد به من بيانات، وكذا التحقق من صحة التوقيع الوارد عليه ونسبه إلى موقعه، وهذا ما نص عليه المشرع الجزائري في المادة 28 من قانون 18-05 المتعلق بتنظيم التجارة الإلكترونية والتي كان مضمونها الإشارة إلى وجوب تأمين مواقع التجارة عبر الأنترنت بنظام التصديق الإلكتروني. وتتم هذه المرحلة بتدخل طرف ثالث محايد يعرف بجهة التصديق والتي هي عبارة عن هيئة أو جهة معينة تقوم بإصدار شهادات تسمى بشهادات التصديق الإلكتروني. نظرا لأهمية هذه المرحلة فقد سنت العديد من الدول تشريعات قانونية تناولت القواعد العامة المتعلقة به وتحديد الجهات المكلفة بالقيام بهذه المهمة وبيان التزاماتها ومسؤولياتها وهذا ما قام به المشرع الجزائري أيضا من خلال قانون 15-04 المحدد للقواعد العامة المتعلقة بالتوقيع والتصديق الإلكترونيين. Abstract: The electronic Certification of the signature is considered the most important stage in concluding all kinds of electronic transactions, this importance is due to the prominent role it plays in concluding the contract and ensuring the validity of the data contained in it, moreover inverifying the authencity of the signature on it and its attribution to its owner. This is indeed what the Algerian legislator stipulated in Article 28 of the Law 18-05 related to the regulation of electronic commerce, it reiterated the necessity of securing online commerce sites with the electronic authentication system. This process nessicates the intervention of a neutral third party known as the certification body, which is a specific body that issues electronic certification certificates. In view of the importance of this stage (process), many countries enacted legal legislations that determine its general rules and specify the bodies(institutions) in charge of carrying out this task and precising their obligations and responsibilities, the Algerian legislator has also done so through Law 04-15 specifying the general rules related to electronic signature and certification. ,.
