الحماية القانونية للطفل في الجزائر

الملخص
إذا كان المجتمع الدولي یرغب في تحقیق الغایة المتمثلة في حمایة حقوق الإنسان عامة وحقوق الطفل بصفة خاصة ،یجب أن يتم تدارك تهمیش واحترام خصوصیات هذه الأخيرة ، حيث یجب أن تكون لدى المسؤولین رغبة سیاسیة حقیقیة في الدفع قدماً لتفعیل هذه الحقوق المعترف بها سواء على المستوى الدولي أو الوطني ،وتهدف أهمية الدراسة إلى الحمایة القانونیة للطفل في الجزائر طبقاً لما هو مكرس في النصوص القانونیة سواء تلك التي تعتبر الجزائر فیها طرفاً أو تلك المكرسة في أهم القوانین الوطنیة بما لها من انعكاس على الواقع المعيش .وكذا تحديد ضمانات حقوق وبقاء الطفل ونماءه في القانون الجزائري ضمن اتفاقية 1989 ، لتسليط الضوء على مجال حماية حقوق الطفل بمجملها ،وبيان أهميتها في القانون الوطني. ومنه ،فقد توصلنا أنه هنالك نوع من الوعي من طرف المشرع بأهمیة هذه الفئة خاصة بإصدار قانون خاص بالأحداث ،وتعدیل العدید من القوانین الوطنیة المعنیة بمسائل الأطفال لتتلاءم مع المعاییر الدولیة ،مع إنشاء آليات وطنية لحماية الأطفال من الانتهاكات ،إضافة إلى تفعيل دور القضاء في التصدي لكل ما من شأنه المساس بحقوق الأطفال بشتى أنواعها. If the international community wishes to achieve the goal of protecting human rights in general and the rights of the child in particular, the marginalization and respect for the particularities of the latter must be remedied, as officials must have a real political desire to push forward activate these recognized rights, both at the international level The importance of the study aims at the legal protection of the child in Algeria according to what is enshrined in the legal texts, whether those in which Algeria is considered a party or those enshrined in the most important national laws with their reflection on the living reality. As well as determining the guarantees of the rights, survival and development of the child in the law Algerian within the 1989 Convention, to shed light on the protection of the rights of the child in its entirety, and to indicate its importance in national law. And from it, we found that there is a kind of awareness on the part of the legislator of the importance of this category, especially by issuing a special law on juveniles, and amending many national laws concerned with children’s issues to conform to international standards, with the establishment of national mechanisms to protect children from violations, in addition to activating the role of the judiciary in addressing Everything that would prejudice the rights of children of all kinds.
