التكييف القانوني لجرائم الاحتلال الفرنسي في الجزائر

الملخص

تهدف هذه الدراسة إلى تسليط الضوء حول التكييف القانوني للجرائم الدولية المرتكبة من قبل المستعمر الفرنسي ضد الجزائريين إبان فترة الاحتلال، والتي لا تنحصر فقط على الجرائم الدولية المرتكبة فوق الإقليم الجزائري بل تتعداه إلى الإقليم الفرنسي، كما أن الفترة الزمنية التي وقت فيها هذه الجرائم لا تنحصر فقط في فترة الثورة التحريرية المباركة "1954-1962"، بل تعود إلى ما قبل ذلك، أي طول الفترة الاستعمارية "1830-1962" . في نفس السياق، فإن الانتهاكات الجسيمة التي ارتكبها الاحتلال الفرنسي في الجزائر، تعد من أبشع الجرائم الدولية خطورة نظرا لاستهدافها إبادة الجزائريين، التعذيب، التهجير، التجارب النووية وغيرها من الجرائم الأخرى. الخ، والتي ترقى حسب أحكام القانون الدولي، القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان إلى جرائم ضد الإنسانية، جرائم الإبادة الجماعية جرائم الحرب. This study aims to shed light on the legal adaptation of the international crimes committed by the French colonizer against the Algerians during the period of occupation, which are not limited to international crimes committed over the Algerian territory, but also extend to the French territory, and the time period in which these crimes were not limited to Only in the period of the blessed liberation revolution (1954-1962), but rather it goes back to before that, and extends the length of the colonial period (1830-1962). In the same context, the grave violations committed by the French colonizer in Algeria are among the most heinous international crimes due to their targeting of the extermination of Algerians, torture, displacement, nuclear tests and other crimes..etc, which amount to according to the provisions of international law, international humanitarian law and international law. Human rights to crimes against humanity, genocide, war crimes.
