الملخص
تسعى المجتمعات الحديثة إلى إيجاد قاعدة قانونية صلبة لضبط العلاقة الاستراتيجية بين البيئة والتنمية المستدامة التي تسعى للمحافظة على البيئة باعتبارها المصدر الرئيسي الذي تأخذ منه الموارد لتحقيق أهدافها باستغلال موارد البيئة بأسلوب عقلاني لضمان استمرارها في العطاء، وينبغي على الدول عند وضع استراتيجيتها التنموية أن لا تغفل عن البعد البيئي لتحقيق أهدافها ولن يتحقق ذلك دون توازن بينهما وحماية قانونية من منطلق أنّ حماية البيئة هي عنصر أساسي من عناصر التنمية المستدامة وغايتها الوصول إلى ما يسمى اليوم، بالاستدامة البيئية، وعليه فإن هذه الدراسة تهدف إلى ابراز العلاقة الحيوية القائمة بين البيئة والتنمية المستدامة وحمايتها لأنها أساس التنمية المستدامة. The modern communities aim at finding a solid and basic law in order to maintain the strategic relationship between the environment and the lasting development that aims at preserving the environment since it represents the main, source from which it derives the sources in order to reach its goals by exploiting , the environmental sources must wisely be used in order to warrant its supply and the countries must not, when they set their developmental strategies, neglect the environmental dimension in order to realize its objectives and it will not be realized without making a balance between them and a juridic protection from the start that the protection of the environment is the main factor of the elements of the lasting development and its objective is to reach what is called today: the lasting environment so, this study aims at determining the vital relationship that exists between the environment and the lasting development and its protection since it represents the basis of the lasting development.
