دور المخطط التوجيهي للتهيئة والتعمير في حماية البيئة طبقًا لقانون 90/ 29

الملخص
أولت الجزائر عناية خاصة بقطاع التعمير، وذلك نظرا لأهميته، وخطورة النتائج المترتبة عنه، لاسيما تلك المتعلقة بمجال البيئي، فأوجدت العديد من الأدوات، لتهتم بهذا القطاع من بينها؛ المخطط التوجيهي للتهيئة والتعمير، الذي يعتبر من أهم أدوات التعمير المحلية، التي تسعى الدولة من خلاله إلى فرض رقابة على عمليات التعمير، وتكريس حماية فعالة للبيئة، من الممارسات التي تمسها نتيجة التصرفات غير العقلانية من قبل الأفراد، وعليه فقد عمد المشرع الجزائري إلى سن قوانين تنظم النشاط العمراني، وصيانة المحيط البيئي، وبذلك تحقيق المصلحة العامة. وبناءا على ما سبق فإن هذه الورقة البحثية تهدف إلى التعرف على المخطط التوجيهي للتهيئة والتعمير، وكذا بيان دوره في حماية البيئة، وقد خلصنا في الأخير إلى أن المخطط التوجيهي من بين أدوات التهيئة والتعمير المحلية، التي لها دور مهم للغاية في فرض رقابته على التوسع العمراني والحد منه، وذلك من أجل الحفاظ على النظام العام البيئي. Algeria has paid special attention to the reconstruction sector, due to the importance and seriousness of its repercussions, especially those related to the environmental field, Therefore, it has created many tools to take care of this sector, including the planning and reconstruction guide, which is considered one of the most important tools for local reconstruction, through which the state seeks to control reconstruction processes and devote effective protection to the environment, from practices that affect it as a result of irrational behavior individuals, the Algerian legislator has enacted laws that regulate reconstruction, activity and preservation of the environment in the interest of the public. Based on the above, this research paper aims to define the planning and reconstruction guide, as well as clarify its role in protecting the environment, and we concluded in the end that the structural plan is one of the tools for local preparation and reconstruction, and has an important role in imposing its control on urban expansion in order to preserve the overall ecosystem.
