الملخص
تبحث هذه الدراسة إلى تسليط الضوء على الممارسة الدولية المعاصرة لمفهوم التدخل الدولي الإنساني في ظل إنحسار مبدأ السيادة، فضلا عن محاولة إبراز مدى شرعية ومشروعية التدخل الدولي الإنساني باعتباره من بين الآليات التي أخذ بها المجتمع الدولي لحماية حقوق الإنسان من الإنتهاكات الجسيمة، في نفس السياق فإن تزايد الإهتمام الدولي بمسألة حماية حقوق الإنسان وتراجع مفهوم السيادة المطلقة، فتح الباب واسعا أمام التدخل الدولي الإنساني، مما أدى في الكثير من الأحيان إلى إساءة إستخدامه، بسبب عدم إحترام شروطه وضوابطه التي تهدف أساسا إلى تحقيق أهداف إنسانية بالدرجة الأولى عوض تقويض سيادة الدولة و التدخل في شؤونها الداخلية . Abstract: This study seeks to shed light on the contemporary international practice of the concept of international humanitarian intervention in light of the decline of the principle of sovereignty, as well as an attempt to highlight the legitimacy and legitimacy of international humanitarian intervention as one of the mechanisms adopted by the international community to protect human rights from grave violations, in the same context, The increasing international interest in the issue of protecting human rights and the decline of the concept of absolute sovereignty, opened the door wide to international humanitarian intervention, which in many cases led to its misuse, due to the lack of respect for its conditions and controls, which mainly aim to achieve humanitarian goals in the first place instead of undermining the sovereignty of the state and intervention in its internal affairs.
