الملخص
تهدف هاته الدراسة للتطرق إلى موضوع المتاجرة بالبشر من الناحية الاقتصادية كون أن الموضوع جديد من الناحية القانونية ذاع صيته في السنوات الأخيرة كونه أصبح ثالث تجارة في العالم بعد تجارة المخدرات والسلاح و لماله من خطورة على حياة الأفراد ومساسه بحقوق الإنسان خاصة ما تعلق منها ببيع الأعضاء البشرية سواء كانوا لأشخاص أحياءا أو أموات وهاته الظاهرة أخذت مفهوم البعد المكاني والزماني بعد تطور مجال الرقمنة,ومما زاد الأمر صعوبة خاصة عند القانونيين هو مسالة رضا المتاجر به هل يدخل في الحسبان عند مسالة تجريم هاته الظاهرة كونه المستفيد ماديا منها أم الأمر مرتبط بالصالح العام والسياسة العقابية للدول مع التركيز على الجهود الوطنية والدولية لمكافحتها كل هذا عن طريق البحث عن الجدلية القائمة بين التجار بالبشر والذين يستعملونها كمصدر للثروة وكذا المتاجر بهم والذين يبحثون عن مصدر رزق لهم . This study aims to address the issue of human trafficking from an economic point of view, since the topic is new from a legal point of view, and has gained fame in recent years, as it has become the third trade in the world after drug and arms trade, and because of its danger to the lives of individuals and its infringement of human rights, especially those related to the sale of human organs Whether they are people living or dead, and this phenomenon took the concept of the spatio-temporal dimension after the development of the field of digitization What made the matter even more difficult, especially for jurists, is the issue of the satisfaction of the trafficker. Does he take into account the issue of criminalizing this phenomenon as he is the material beneficiary of it, or is the matter related to the public interest and the punitive policy of countries with a focus on national and international efforts to combat it all by looking for the existing controversy among traders Humans and those who use it as a source of wealth, as well as the traffickers and those who are looking for a source of livelihood for them.
