أحكام تقديم الدفع بعدم دستورية القوانين في التعديل الدستوري الجزائري 2020 - بين متطلبات التأصيل الدستوري وتجليات التأطير القانوني - (دراسة مقارنة)

الملخص
يعالج المقال وسيلة الدفع الفرعي بعدم دستورية القوانين في ضوء مستجدات التعديل الدستوري الجزائري لسنة 2020، باعتبارها أحد آليات الرقابة الدستورية البعدية، ويركز مجال الدراسة على الأحكام الناظمة للشروط الشكلية والموضوعية المتطلبة لتقديم الدفع بعدم الدستورية ، بالإضافة إلى كيفيات تقديم الدفع بعدم الدستورية أمام الجهات القضائية والسلطات الممنوحة لها في التعامل معه حسب ما يقره التشريع الساري المفعول (القانون العضوي 18/16)، واستشراف التشريع المرتقب صدوره تطبيقا لما جاء في التعديل الدستوري الجزائري لسنة 2020، وتهدف الدراسة إلى فحص مدى دقة وجدوى وتناسب الأحكام الدستورية والقانونية الناظمة لتقديم الدفع بعدم الدستورية من حيث كفالتها للتوازن بين حق التقاضي من جهة، وضمان فعلية وفعالية العمل القضائي وانتظامه من جهة أخرى The article deals the means exception of unconstitutionality of laws in the developments Algerian constitutional amendment of the year 2020, which is considered one of the tools of constitutional control, and the scope of the study is limited to the provisions that regulate the formal and substantive conditions required to present exception of unconstitutionality, in addition to the methods of presenting the exception of unconstitutionality before the authorities Judicial authorities and the powers granted to them in dealing with him as approved by the legislation in force (Organic Law 16/18),and foreseeing the legislation expected to be promulgated according to what was stated in the Algerian Constitutional Amendment of 2020, and the study aims to examine the accuracy, feasibility and proportionality of the constitutional and legal provisions regulating the submission exception of unconstitutionality in terms of ensuring the balance between the right to litigation on the one hand, and ensuring Actual, effective and regular judicial work on the other hand
