المسألة الاجتماعية وفقه الأولويات.

الملخص
ملخص. حاولت من خلال هذا البحث ربط مقاصد الشريعة الإسلامية بمعالجة الأوضاع الاجتماعية (البطالة، والفقر، والتشرد، والجهل...) وذلك باستحضار بعض القواعد المنهجية في مقاصد الشريعة الإسلامية التي يمكن التعبير عنها ب"فقه الأولويات" أو ب"فقه الموازنات". فما تفتقده الأمة اليوم وما تحتاجه لا يعدو أن يكون من قبيل المصالح الضرورية أو الحاجية أو التحسينية، وتعاملنا مع المسألة الاجتماعية يقتضي إقامة المصالح الضرورية أولاً التي تُعد الأولى والأحق من المصالح الأخرى التي قد تكون من قَبيل القسم الحاجي، أو التحسيني. وإن القسم الضروري يضم أولويات كذلك لابد من ترتيبها وتنظيمها، فحفظ الدين مقدم على حفظ النفس، وحفظ النفس مقدم على حفظ العقل، وحفظ العقل مقدم على حفظ العرض إلخ... وكل مستوى من هذه المستويات له مجالاته الاجتماعية التي تُقام وتُحفظ بِحفظ هذه المصالح، وِفق هذا الترتيب المنهجي المحكم. الكلمات المفتاحية. مقاصد الشريعة الإسلامية – الأوضاع الاجتماعية - المصالح الضرورية – المصالح الحاجية – المصالح التحسينية. Abstract Through this research, I tried to link the purposes of Islamic law to address social conditions (unemployment, poverty, homelessness, ignorance...) by evoking some methodological rules in the purposes of Islamic law that can be expressed as "jurisprudence of priorities" or "jurisprudence of budgets." What the nation needs today, and what it lacks is nothing more than one of the necessary, needy or complementary interests, and our dealing with the social issue requires establishing the necessary interests first that are the first and the right of other interests that may be like the needs section, or complementaries. The necessary section also includes priorities that must be arranged and organized. Conservation of religion is preceded by self-preservation, self-preservation is preceded by the preservation of reason, and preservation of the mind is preceded by the preservation of offspring etc. ... Each of these levels has its own social fields, which are established and preserved by preserving these Interests according to this tight, systematic arrangement.
