Description

A biannual specialized international academic journal concerned with publishing research and studies in jurisprudence and the judiciary. Published by Eloued University. It aims to support scientific research in the fields of jurisprudence and jurisprudence, as it is a specialized journal. It publishes research papers in Arabic, English and French. It welcomes all contributions of professors, researchers and doctoral students from all over the world. The research and studies nominated for publication in the journal are required to fall within the journal's specializations, with the necessity to respect the objective treatment in accordance with the documented scientific method, while adhering to the principles of scientific research and its general rules and university norms in the accurate documentation of research materials.

الإبانة في تأصيل أحكام الحضانة -دراسة أصولية تقعيدية مقارنة-

الملخص: تتمحور فكرة هذا المقال حول دراسة أصوليّة لأحاديث باب الحضانة ،حيث ذكرت في هذا البحث الأسباب التي أدّت إلى التعارض بين أحاديث الحضانة،مع تباين أنظار الفقهاء واختلاف مسالكهم في دفع هذا التعارض ،وأشرت كذلك إلى أبرز القواعد الأصوليّة والفقهيّة المتعلّقة بأحكام الحضانة. وخلص البحث إلى نفي وجود تعارض بين أحاديث الحضانة ،ودفع الوهم الحاصل فيها بالجمع والتّرجيح بينها ،بضوابط تمليها أصول الشريعة وقواعدها، تسهم في ضبط فقه أحكام الحضانة ،و معرفة النّوازل والمستجدّات المتعلقة بها.

مدى إمكانية استخدام الخوارزميات الرقميَّة في العول دراسة تطبيقيّة ومقاربة على المسألة العمريّة

الملخص: تناول موضوع الدّراسة مدى إمكانية استخدام الخوارزميات الرقمية في العول دّراسة تطبيقيّة مقاربة على المسألة العمريّة. واهتمّت مشكلة البحث بلغز عمق الخوارزميات الرقمية في العول، وتطبيقها في المسألة العمرية، ومع تعميق لأصولها وفصولها نشأت أهمية الدّراسة لارتباطها بمبادئ الشّريعة ومقاصده بوصفها الأساس الذّي بني عليه الإسلام أحكام المواريث، بهدف رفع وتحسين كفاءة المسائل الافتراضية بشكل عام، والعمرية بشكل خاصّ. واعتمدت الدّراسة على المنهج الاستقرائي التّحليلي. وتوصلت الدّراسة إلى نتائج منها: تحقيق مفهوم القرآن في أخذ الأم لنصيبها المفروض من التّركة كاملة وليس الثّلث الباقي،ولم يؤثر الزّوج أو الزّوجة على الأم بعد أن أخذ نصيبهما، ولم يخفضا نصيب الأم بأي شكل من الأشكال، ونرى أن الأب أخذ الباقي تعصيباً. وأوصت الدّراسة بتقديم الخوارزمية المقترحة، والتّي بدورها تقارب الافتراضين بإعطاء الأم فرضها دون التّأثيرعلى فرضها مع اصحاب الفروض في المسالتّين، وإعطاء الأب البقية تعصيباً. ABSTRACT: The subject of the research referred to the extent to which algorithms can be used in counting: an applied study on the question of age or an approach study. The study came up, including the concept of the Qur'an, the mother took her imposed share of the entire property and not the remaining third, and the husband or the women did not affect the mother after they took their part, and the mother did not diminish it in any way. Some form, and we see that the father took the rest by heart. The study recommended that we rather stick with the proposed algorithm, which in turn approximates the two hypotheses by giving the mother her hypothesis without affecting her hypothesis with the hypotheses in the two problems, and giving the father the rest.

دور المواءمة التشريعية في دعم الدراسات الفقهية والقضائية The Role of Legislative Harmonization in Supporting Jurisprudential and Judicial Studies

الملخص: يدرس هذا البحث مظاهر تأثير المواءمة التشريعية في الدراسات الفقهية والقضائية، ويهدف إلى تحديد المقصود بالمواءمة التشريعية وبيان أهميتها، وإلى التأكيد على ضرورة التواصل بين الدراسات النظرية والتطبيق التشريعي، كما يهدف إلى بيان أثر المواءمة التشريعية في الدراسات الفقهية والقضائية، مع الإشارة إلى الأثر العكسي؛ وذلك ببيان دور الدراسات النظرية والنقدية في تفعيل المواءمة، ومن أهم نتائج البحث أنّ المواءمة التشريعية تتأثر بالدراسات الفقهية والقضائية في كونها تعرّف بعناصرها ودوافعها، وتبرز حالاتها، وتسعى إلى تطوير سبل تفعيلها، واستدراك نقائصها، والمواءمة بدورها تؤثر فيها وتدْعَمُها، ومن مظاهر تأثيرها أنها تعزّز أهداف الدراسات الفقهية والقضائية، كما أنها تُثري التشريعات بالتصورات والاجتهادات الدولية المختلفة، بالإضافة إلى أنها تشكّل دعامة نقدية واستدلالية فعالة في هذه الدراسات. This research studies the influence manifestations of the legislative harmonization in jurisprudence and judicial studies. It aims to define the legislative harmonization and explain its importance. Also to confirmation the need for communication between theoretical studies and legislative activation. It also aims to demonstrate the impact of legislative harmonization in jurisprudence and judicial studies. Noting the reverse effect; through explaining the role of theoretical and critical studies in activating harmonization. Among of the most important results of the research is that legislative harmonization is influenced by jurisprudential and judicial studies, because it defines its elements and motives, highlights its cases, seeks to develop ways to activate it, and rectifies its shortcomings. Harmonization, in turn, affects and supports it, and among the manifestations of its influence is that it enhances the goals of jurisprudential and judicial studies. It also enriches legislation with different international perceptions and jurisprudence. In addition, it constitutes an effective critical and inferential support in these studies
