أثر القوة التعاقدية للمتعاقد على قانون العقود.

الملخص
ملخص: أثّر ظهور ظاهرة القوة التعاقدية للمتعاقد على مفهوم العقد، بحيث كان التصوّر الكلاسيكي للعقد يرفض و يتجاهل هذه القوة التعاقدية، و ظهر نتيجة ذلك عدم انسجام بين التصوّر النظري و الواقع العملي، و هو ما سبّب اضطراب كبير لذلك التصوّر الكلاسيكي، لكن بعد أن صار قانون العقود يعترف بظاهرة القوة التعاقدية، و هذا ما كرّسه القانون الجزائري، عبر السماح للمشرع و القاضي للتدخّل في العقد، لحماية المتعاقد الضعيف بصورة واسعة المجال، و بتقنيات متنوّعة و متعدّدة، ساهم ذلك في إثراء و تطوّر مفهوم العقد، و عليه سيكون البحث في إطار هذه الدراسة، حول مساهمة مظاهر هذه القوة التعاقدية، في تراجع أم في تطوّر العقد؟ و من جهة أخرى، الوصول إلى ضرورة تجديد النظرية العامة للعقد. Abstract: The impact of the phenomenon of the contractual power of the contractor on the concept of the contract , so that the classical conception of the contract rejects and ignores this contractual force, and the result appeared a lack of harmony between the theoretical perception and the pratical reality, which caused a great disturbance to that classical perception , but now that the law of contracts recognizes the phenomenon contractual force, as enshrined in algerian law, by allowing the legislator and judge to intervene in the contract, to protect the weak contractor, in a wide range, and with a variety of techniques, this contributed to the enrichment and development of the concept of the contract, therefore , the research in this study, on the contribution of the manifestations of this contractual force , will be to decline or to the development of the contract? On the other hand , the need to renew the general theory of the contract is reached.
