الضبط الاقتصادي: أيّ دور في إعداد القاعدة القانونية؟

الملخص
الملخص: لم تعد تخضع مهمة إعداد القواعد القانونية لاحتكار الدولة عبر سلطاتها المختلفة، بل صارت تخضع لمنطق التعدّدية و المشاركة في إعداد تلك القواعد، من قبل الفاعلين في السوق، كما لم تعد مصادر القانون تتصّف بالعمومية ، و تطبّقها الدولة على جميع الأفراد، بل صارت هناك مصادر خاصة للقانون، تطبّق على مجموعة من الأشخاص داخل السوق، و على قطاع معيّن و فقط، لكن من جهة أخرى ثبت دائما وجود مواجهة مستمرة ما بين متطلّبات الضبط الاقتصادي و سلطة الدولة، و هذا على عدة مستويات، سواء في إطار الدور المؤسّساتي لسلطات الضبط الاقتصادي، التي ظهرت بأنّها مؤسّسات هجينة، ما بين الفاعلين في السوق و سلطة الدولة، فضلا عن عدم كفاية الاستجابة القوية لقانون الضبط لمقتضيات السوق، لكي تتخلّص من تأثير سيادة الدولة، و هذا ما جاء به الضبط الاقتصادي في إطار دوره في إعداد القاعدة القانونية تشكيلا و تكوينا. Abstract: The task of preparing the legal rules is no longer subject to the monopoly of the state through its various authorities, but it is subject to the logic of pluralism and participation in the preparation of these rules by the actors in the market, as the sources of the law are no longer characterized by generality, applied by the state to all individuals, but there are special sources The law applies to a group of people within the market, and only to a particular sector, But on the other hand, there has always been a constant confrontation between the requirements of economic regulation and state authority, and this at several levels, This is on several levels, both in the context of the institutional role of the economic regulation authorities, which appeared to be hybrid institutions, between the actors in the market and the state authority, as well as the insufficiency of the strong response of the law of regulation to the requirementsof the market, in order to get rid of the influence of state sovereignty, and This is what economic regulation brought in the context of its role in preparing the legal in form and composition.
