أيّ مستقبل للخطأ في ظل تطوّر نظام المسؤولية المدنية؟

الملخص
الملخص: يواجه الخطأ مصيرين مختلفين بشأن دوره في نظام المسؤولية المدنية، فبشأن الوظيفة التعويضية للمسؤولية، فإن دوره قد أقصي بصورة واسعة، فأحيانا استبدل بنظام التعويض التلقائي الذي أقصاه تماما من فكرة التعويض، و أحيانا أخرى، يواجه الخطأ إقصاء غير مباشر و ضمني، عبر تغيير مفهوم الخطأ المدني، و تزايد تقنية التأمين من أجل ضمان التعويض. إلاّ أنّه من جهة أخرى، و بشأن الوظيفة العقابية للمسؤولية المدنية، فللخطأ دور بارز في الحفاظ على وظيفته العقابية، سواء في إطار نظام المسؤولية المدنية، أو حتى في نظام التعويض التلقائي الذي لم يستبعد الخطأ بصورة نهائية، و ما زاد في ذلك تلك الوظيفة العقابية الجديدة، عبر الاعتراف بفكرة التعويضات العقابية التي أعادت الاعتبار للخطأ بصورة واسعة. Abstract: The wrong faces two different fates regarding its role in the civil liability system. Concerning the compensatory function of liability, its role has been largely excluded, sometimes it was replaced by the automatic compensation system, which completely excluded it from the idea of compensation, and at other times, the wrong faces indirect and implicit exclusion, by changing the concept of civil wrong and increasing the technique of insurance in order to guarantee compensation. However, on the other hand, concerning the punitive function of civil liability, the wrong has a prominent role in maintaining its punitive function, whether within the framework of the civil liability system, or even within the automatic compensation system that did not completely exclude the wrong, and what is more than that is the new punitive function, by recognizing the idea of punitive compensation, which has broadly reconsidered the wrong.
