الملخص
الملخص: من أهم الجوانب الطبية الحديثة نجد التجارب الطبية والعلمية، التي تمثل ذلك الجانب الذي يلعب فيه الطب دوراً رائداً متميزاً، يهدف إلى تحقيق أقصى درجات الكمال والسلامة والسمو للإنسان، وهو دور يتميز بالتدخل الطبي الإيجابي لتحقيق نتائج تستعصي على مراحل النمو البشري الطبيعي، فما يقوم به العلماء والأطباء والباحثون في المجال الطبي من تجارب يعكس التطور المستمر في العلم، والذي كان له الدور الكبير في الإنجازات العلمية. فاكتشاف مرض معين وإيجاد العلاج له لم يأت صدفة، وإنما قد جاء وفق قوانين موضوعية قائمة على منهج التجربة، إلا أنه ورغم هذه الإنجازات والتجارب الطبية تبقى سلاحاً ذو حدين، يحمل بين طياته المخاطر والمزايا من تلك التجارب النافعة صاحبة الفضل بعلاج الكثير من الناس، إذ لا تزال الأبحاث والتجارب العلمية والطبية تثير اهتمام أغلب مشرعي دول العالم ومنها المشرع الجزائري، فلا تزال الآراء الشرعية والفقهية غير مستقرة ومتشابكة حول الإقرار بمشروعية هذه التجارب. Abstract : One of the most important modern medical aspects is the medical and scientific experiments, which represent that aspect in which medicine plays a distinctive pioneering role with the aim of achieving the utmost levels of perfection, safety and transcendence for the human being, a role characterized by positive medical intervention to achieve results that are difficult to achieve in the stages of normal human development, what scientists, doctors and researchers do In the medical field, experiences reflect the continuous development of science, which has had a great role in scientific achievement, The discovery of a specific disease and the existence of treatment for it did not come by chance, but rather according to objective laws based on the methodology of the experiment. However, despite these medical achievements and experiments, it remains a double-edged sword that carries with it the risks and advantages of those beneficial experiences that are credited with treating many people, as they are still Scientific and medical research and experiments are of interest to most of the world's legislators, including the Algerian legislature, as legal and jurisprudential opinions are still unstable and intertwined regarding the recognition of the legitimacy of these experiments.
