الملخص
بالموازاة مع عملية إعداد مسح الأراضي العام والترقيم في السجل العقاري وبصفة مستقلة عنهما. سن المشرع القانون رقم 07-02 لإجراء تحقيق عقاري لتحديد الأوعية العقارية من خلال تحديد العقود وتسلم سندات الملكية، في المناطق التي لم يمسها المسح، خاصة أمام تزايد الإشكالات التي خلفها تطبيق المرسوم المتعلق بعقد الشهرة، الملغى. غالبا ما تفرز عملية التحقيق العقاري منازعات، تحل عن طريق محاولات إجراء الصلح أو عن طريق الجهات القضائية المختصة، وفق لما ورد في أحكام القانون رقم 07-02 والمرسوم التنفيذي رقم 08-147، ومختلف التعليمات الصادرة عن المديرية العامة للأملاك الوطنية.
