الاستقالة والإضراب بين حق الممارسة والتزام الموظف بمبدأ حسن سير المرافق العامة (دراسة تحليلية في ظل التشريع الجزائري)

الملخص
يقتضي مبدأ سير المرافق العامة بانتظام واضطرد، ضرورة تقديم الخدمات بانتظام ودون انقطاع، لكن الإشكال يكمن في ممارسة الموظف لبعض من حقوقه المكفولة قانونا، التي لها أثر مباشر على مبدأ استمرارية المرفق، وهي حق الموظف في تقديم الاستقالة واللجوء للإضراب، لذا ينبغي البحث عن الإطار الذي يجب أن يتم فيه ممارسة هذه الحقوق بما يكفل الاحترام التام للمبادئ الدستورية، وفي مقدمتها مبدأ استمرارية المرافق العامة، وعليه نجد أن المشرع نص على جملة من الالتزامات والضوابط التي يجب على الموظف العام مراعاتها والتقيد بها في ممارسته لحق الاستقالة والإضراب، ضمانا وتكريسا لمبدأ استمرارية المرافق العامة بانتظام واضطراد. The principle of regular and steady functioning of public facilities requires that services be provided regularly and without interruption, but the problem lies in the practice by the employee of some of his legally guaranteed rights, which have a direct impact on the principle of continuity of the facility, namely the right of the employee to resign and to strike, Therefore we should look for the framework in which these rights should be exercised in order to ensure full respect for the constitutional principles, especially the principle of the continuity of public utilities. That is why, we find that the legislator confirmed some commitments and controls that the employee should take into consideration in his practice for the right of resignation and strike in order to ensure the principle of continuity of public utilities regularly and steadily.
