تفعيل مبدأ الشفافية قبل عملية إبرام الصفقة العمومية للوقاية من الفساد

الملخص
نظرا لارتباط الصفقات العمومية بالفساد حرص المشرع الجزائري على إخضاع عملية إبرام الصفقات العمومية لأحكام خاصة، و حدد المبادئ الهامة التي يجب أن تستند إليها هذه العملية ،ومن بين أهم هذه المبادئ مبدأ شفافية الإجراءات،و هو الوسيلة التي من خلالها يمكن الوصول إلى تحقيق المبادئ الأخرى المتمثلة في مبدأ المساواة والمنافسة الحرة،كما نص المشرع في قانون الإجراءات المدنية والإدارية 08-09 على الطعن الاستعجالي كآلية وقائية يمكن تفعيلها قبل إبرام العقد رغبة منه في تأمين أكبر قدر ممكن من شفافية الإجراءات عند إبرام الصفقة ،ومنح القاضي الاستعجالي سلطات استثنائية غير معهودة في مواجهة الإدارة وإجبارها بالامتثال لقواعد الشفافية والمنافسة تجعل منه إجراءا استثنائيا في غاية من الأهمية للوقاية من الفساد في مادة الصفقات العمومية. In view of the association of public deals with corruption, the Algerian legislator was keen on subjecting the process of concluding public deals to special provisions, and he identified the important principles on which this process should be based, and among the most important of these principles is the principle of transparency of procedures, which is the means by which the achievement of other principles can be achieved. Of the principle of equality and free competition,The legislator also stipulated in the Civil and Administrative Procedures Law 08-09 the urgent appeal as a preventive mechanism that can be activated before the conclusion of the contract in order to secure the greatest possible transparency of the procedures when concluding the deal, and granting the urgent judge extraordinary powers that are unusual in facing the administration and compelling it to comply with the rules of transparency And competition makes it an exceptional measure of great importance to prevent corruption in public procurement.
