الملخص
ملخص: لقد احتل الفقه الإسلامي في الجزائر موقعا حيويا ضمن عائلة "العلوم الإسلامية الأصيلة"،وإن كان تعرض لنكبات في تاريخه الممتد،وعرضت له عراقيل ذاتية،وخارجية؛ أبطأت حركته،وجمدت نشاطه،ولكنه مع مرور القرون أثبت رسوخه،وعافيته، وذلك على أيدي علماء جزائريين أفذاذ؛قاموا بخدمته خدمة جليلة،ووقفوا بحزم وعلم في وجه كل محاولات الاحتلال الفرنسي اليائسة الفاشلة للقضاء عليه،واستطاع أن يخرج منتصرا من معاركه،ولكنه مع ذلك يحتاج الآن إلى خدمة عصرية من أبناء جيل الاستقلال،تواصل مسيرة أولئك العلماء،عبر حصره،وتصنيفه،وتقنينه،وإنها لمهمة ليست بالمستحيلة إذا تضافرت جهود أبناء هذا الوطن المخلصين،وتأتي هذه الدراسة لتميط اللثام عن تاريخ التشريع في الجزائر خلال العهد العثماني،مرورا بالحقبة الاستعمارية الفرنسية،إلى ما بعد استقلال الجزائر،ومن أهم نتائج البحث هو أن العلماء الجزائريون أثبتوا حضورهم التاريخي،كحراس أمناء على مقومات هذا البلد،ومرجعيته المتمثلة في الفقه الإسلامي، وسجل التاريخ أمجادهم،رغم محاولات الطمس الحضاري،وترسانة التشريعات،والقوانين من طرف الاحتلال الفرنسي. Abstract: Islamic Jurisprudence occupied in Algeria a vital outpost in family of “Authentic Islamic sciences”, But he suffered has been plagued in its history, and blocked him a lot of obstacles subjective and external; slow us down and froze him active, But he’s with over the centuries prove him entrenched and its recover; carried out by an extraordinary Algerian Scholars; they had serve him; a great service, and stood up firmly and science in the face of all failed French occupation to eradicate it, and can get victorious in all battles, But nevertheless now needs a modern service by the sons of generation of the independence; will continue the path those scholars, by confined ,classified ,and legalized, Its an mission was not impossible, if we combine efforts loyal sons of this motherland, This study comes to reveal the history of legislation in Algeria during the Ottoman era, Through the French colonial period, Until after the independence of Algeria, one of the most important results of the research is that the Algerian jurists proved their historical presence as faithful guards of the foundations of this country and its reference is Islamic jurisprudence, And history recorded their glories,Dispite attempts to obliterate civilization, And the arsenal of legislation and laws by the French occupation.
