الوصية بتبرع الأعضاء البشرية بين المؤيدين والمعارضين: دراسة مقارنة بين الفقه الإسلامي والقانون الوضعي The Will To Donate Human Organs Among Supporters And Opponents: A Comparative Study Between Islamic Jurisprudence And Positive Law

الملخص

تطورت عمليات زرع ونقل الأعضاء البشرية تطورا ملحوظا خلال النصف الثاني من القرن العشرين، محققة بذلك نجاحات باهرة، الأمر الذي استدعى البحث عن الحكم الشرعي والقانوني لهذه العمليات والضوابط التي تحكمها. ونشطت على المستوى الشرعي المجامع الفقهية والمؤتمرات الدولية التي عقدت لهذه الظاهرة، مما شجع التشريعات في بعض الدول على تنظيم ذلك في نصوص قانونية، خاصة فيما يتعلق بوصية التبرع بالأعضاء بعد الممات. لذا سعيت إلى البحث عن حكم وصية التبرع بالأعضاء في الفقه والقانون. ولدراسة الموضوع، ارتأيت أن أعالجه في ثلاثة مباحث أساسية: نعرض في الأول تحديد لمصطلحات البحث، وفي الثاني حكم الوصية بالتبرع بالأعضاء البشرية فقها وقانونا، أما المبحث الثالث فخصصته لشروط وضوابط الوصية بالتبرع بالأعضاء. The process of transplanting and transferring human organs developed significantly during the second half of the twentieth century, achieving remarkable successes, which necessitated the search for the legitimate and legal ruling on these operations and the controls that govern them. At the Sharia level, the jurisprudence councils and international conferences held for this phenomenon were active, which encouraged legislation in some countries to regulate this in legal texts, especially with regard to the will to donate organs after death. So I sought to research the ruling on the will of organ donation in jurisprudence and law. In order to study the topic, I decided to address it in three main sections: In the the first, we present a definition of the search terms, and in the second, the ruling on the will to donate human organs in jurisprudence and law. As for the third section, I devote it to the conditions and controls of the will to donate organs.
