الحجر على المجنون والمعتوه في الفقه الإسلامي والقانون الجزائري

الملخص
ملخص: يعتبر الجنون من أسباب الحجر المتفق عليها عند الفقهاء والقانونيين،والجنون هو اختلال في العقل؛بحيث يخرج صاحبه عن النهج الطبيعي في الأعمال المعتادة،وهو مسقط لأهلية الأداء،والمجنون كالصبي غير المميز في عجزه عن الاهتداء إلى التصرفات النافعة له؛فيمنع من التصرف في ماله رعاية لمصلحته،والعته اختلال في العقل أيضا؛بحيث يجعل صاحبه قليل الفهم،مختلط الكلام،لكن لا يضرب،ولا يشتم،بخلاف المجنون؛فهو نوع من الجنون يصحبه هدوء،وقد يكون معه تمييز،فيأخذ صاحبه حكم الصبي المميز،وقد لا يكون مميزا،فيأخذ حكم المجنون،وقد قرر المقنن الجزائري الحجر على المجنون والمعتوه من خلال نصوصه التشريعية،وجاءت هذه الدراسة باقتراحات وتوصيات لتعديل بعض هذه النصوص. The madness is one of the reasons for the interdicting agreed upon by all Islamic sharia scholars and jurists,Madness is the imbalance of mind so that the owner is out of the normal approach in the normal business it’s fall the legal agency,the madness is like a boy who is not distinguished in his inability to know the actions that are useful to him it’s prohibited to dispose of its money in the care of its own interest,The Idiot is the imbalance of mind too his little understood,composer makes,speech mis and mis fratzy,silent does not do as the madman does it is a kind of madness that may have discrimination and may not be distinctive this is what the Algerian code has decided through the quaeantine of the madman and the idiot in its legislative texts,this study brought new suggestions for amending some of these texts).
