العقود الذكية كآلية للتعاقد عن بعد Smart Contracts As A Remote Contracting Mechanism

الملخص

ملخص: نسعى من خلال هذا البحث إلى تسليط الضوء على العقود الذكية، المتميزة بالحداثة بإدخال تقنيات التشفير ولغة الحاسوب في تكوين العقد، ناهيك عن التنفيذ الآلي للعقد، وهذا ما يعكس إقتحام التطور التكنولوجي لجميع مناحي الحياة، فلم تسلم منه العقود، في ظل صمود النظرية العامة للعقد، التي وجدت نفسها أمام خيارين فالأول هو مسايرة متطلبات الحياة التعاقدية والقبول بالتعاقد عن بعد الذي من صوره العقود الذكية، أما الخيار الثاني فهو عدم الإنسياق وراء الإستخدام المفرط للبيئة الإلكترونية. وهو ما خلق نوع من الإشكال في تقبل الفكرة لدى التشريعات العالمية. فظهر تباين بين منكر، ومؤيد للفكرة يسعى لإيجاد دمج لهاته العقود في المنظومة القانونية، وهو ما جعلنا نبحث عن كيفية ابرام وتنفيذ هذه العقود، الغريبة على النظرية العامة للعقد. Abstract: Through this research, we seek to shed light on modern smart contracts by introducing encryption techniques and computer language into the contract configuration, not to mention the real-time implementation of the contract. This reflects the introduction of technological development into all aspects of life. Contracts have not been spared, given the resilience of the contract's general theory. Two option were found: The first was to keep pace with the requirements of contractual life and to accept a remote contract, one of which is smart contracts. The second option was to moderate our recourse to this kind of contracts, for the excessive use of the electronic environment created some problems in accepting the idea in global legislation. A disparity has emerged between a denier and a proponent of the idea who seeks to integrate these contracts into the legal system. This has led us to look for how to conclude and implement these contracts, which are alien to the general theory of the contract.
