الملخص
تناولنا بالدراسة موضوع إثبات العقود الذكية، باعتباره موضوع من بين أهم المواضيع التي كان لها الأثر البالغ في تطوير قواعد الإثبات، و ترقيتها تماشيا مع التطور العلمي و التكنولوجي الذي شهدته وسائل الإتصال الحديثة، و ذلك من خلال البحث في حجية الكتابة الإلكترونية و التوقيع الإلكتروني اللذان يهدفان كهدف أساسي في إثبات العقد الذكي، و بذلك فقد اقتصرت الدراسة الحالية على التعريف بالكتابة الإلكترونية من وجهات مختلفة، قانونية و فقهية، و كذا التأصيل في بيان حجيتها في إثبات العقود الذكية، و إلى التطرق لمفهوم التوقيع الإلكتروني و شروطه، و بيان حجيته في إثبات هذا العقد، خروجا بالتوصل لقيمتهما الثبوتية كدليل معترف به من قبل أغلب التشريعات القانونية عامة، و المشرع الجزائري خاصة، و ذلك لما لهما من دور في تحقيق الثقة و الأمان. In the study, we dealt with the subject of proving smart contracts, as it is one of the most important topics that had a great impact on the development of the rules of evidence, and its promotion in line with the scientific and technological development witnessed by modern means of communication, by researching the authenticity of electronic writing and electronic signature, which They aim as a primary objective in proving the smart contract, Thus, the current study was limited to the definition of electronic writing from various legal and jurisprudential points of view, as well as the rooting in the statement of its authority in proving smart contracts, and to addressing the concept of electronic signature and its conditions, and the statement of its authority in proving this contract, in order to reach their probative value As evidence recognized by most legal legislation in general, and the Algerian legislator in particular, because of their role in achieving confidence and safety.
