الملخص
الملخص: إن تتبع المراحل والتطورات التي مر بها المرفق العام كمفهوم ارتقى إلى درجة نظرية قام عليها القانون الإداري؛ تُوجِبُ ضرورة إعادة النظر في هذا الطرح لا سيما في ظل المتغيرات التي تمر بها بلادنا، فالجزائر شهدت كَجُل الأنظمة القانونية الأخرى تحولات كبيرة في الحياة الاقتصادية والاجتماعية، ما حتم ضرورة إعادة النظر وضبط للكثير من المفاهيم؛ لعل مفهوم المرفق العام بطرحه القديم من أبرزها، فاليوم وفي ظل هذه المعطيات صار للخواص؛ أفرادا وتجمعات وللقانون الخاص عموما دورا كبيرا، وهو ما كان في وقت سابق ضربا من الخيال. فالواقع الذي فرض نفسه هو التوجه نحو إشراك القطاع الخاص، أو في بعض الأحيان تفويضه أو التنازل له لتسير قطاعات حيوية كانت حكرا على الدولة؛ الأمر الذي يؤكد مرة أخرى أن الدراسات القانونية ومهما أرتقت واتسمت مبادئها بالثبات تبقى ظاهرة اجتماعية تتأثر بما استجد. الكلمات المفتاحية: تسيير المرفق العام؛ التوجه الجديد ; التفويض ; إشراك القطاع الخاص. Abstract : Tracing the stages and developments that the public utility has gone through as a concept that has been elevated to a theoretical degree upon which administrative law is based; It is necessary to reconsider this proposition, especially in light of the changes that our country is going through. Algeria, like most other legal systems, has witnessed major transformations in economic and social life, which necessitated the need to reconsider and adjust many concepts; Perhaps the concept of public utility, with its old proposition, is one of the most prominent. Individuals and groups The private law in general plays a large role, which was previously a fantasy. The reality that imposed itself is the trend towards involving the private sector, or in some cases entrusting it or conceding to it, to run vital sectors that were the preserve of the state; Which confirms once again that legal studies, no matter how advanced and stable their principles are, remain a social phenomenon affected by what is new.
