الملخص
يعيش العالم اليوم وضعا استثنائيا في ظل انتشار فيروس كورونا الذي أصبح يعد تحديا غير مسبوق للاقتصاد العالمي، نظرا لتأثيره الشامل على كافة القطاعات الاقتصادية، حيث فرض قيودا واسعة النطاق على العديد من الأنشطة، وهو ما دفع بالدول إلى ضرورة تبني سياسات كفيلة للاحتواء السريع لآثار وتبعات الجائحة من أجل إنعاش السوق المحلية والتغلب على الاضطرابات الاقتصادية؛ ولعل من أبرز هذه الحلول استغلال وسيلة العقود الالكترونية كاستجابة آنية لاحتواء هذه الآثار. وقد سرّعت هذه الظروف الخاصة بعجلة التجارة الالكترونية، حيث ساهم التعاقد الالكتروني في مواكبة مرحلة الجائحة؛ بل وعزز مكانته لما بعدها، نظرا لقصور وحتى عجز العقود التقليدية عن تلبية رغبات وحاجيات الافراد، الأمر الذي جعل منها أرضية خصبة للتحوّل الرقمي الذي أبان عن تحولات جوهرية في اقتصاد البلدان، ذلك أن تقدم الدول وصمودها يقاس بوضعية اقتصادها. Abstract: The world lives today in an exceptional situation in light of the spread of the Covid-19, which has become an unprecedented challenge to the global economy, due to its comprehensive impact on all economic sectors, as it imposed wide-ranging restrictions on many activities, which prompted countries to adopt policies that ensure the rapid containment of the effects and consequences of The pandemic, in order to revive the local market and overcome economic turmoil; Perhaps one of the most prominent of these solutions is to exploit the electronic contracts method as a real-time response to contain these effects. These conditions accelerated the acceleration of e-commerce, as electronic contracting contributed to keeping pace with the pandemic stage. Rather, it strengthened its position for what came after it, due to the limitations and even inability of traditional contracts to meet the desires and needs of individuals, which made it a fertile ground for the digital transformation that showed fundamental transformations in the economies of countries, since the progress and resilience of countries is measured by the state of their economy.
