عن إمكانية إثبات نسب المولود نتيجة زواج عرفي في ظل جائحة كورونا

الملخص
الملخص تهدف الدراسة إلى تسليط الضوء على مدى مساهمة الإجراءات الصحية المتخذة لمنع تفشي فيروس كورونا، المتمثلة في تعليق إبرام عقود الزواج في انتشار الزواج العرفي الذي يؤثر في زيادة ارتفاع القضايا المتعلقة بإثبات الزواج وكذا إثبات النسب، إذ أن مصالح الحالة المدنية تمتنع عن تسجيل الأبناء المولودين عن طريق الزواج العرفي لآبائهم لعدم وجود عقد مسجل لديها، ما دفع الكثير من الآباء إلى اللجوء إلى المحكمة من أجل إثبات نسب الأبناء بعد تثبيت عقد الزواج هذا ما لمسناه من خلال الحكم المعتمد كمثال عملي مدعم للدراسة. الكلمات المفتاحية: زواج عرفي؛ نسب؛ كورونا؛ مولود. Abstract: The study aims to shed light on the extent to which the health measures taken to prevent the outbreak of the Corona virus, represented in suspending the conclusion of marriage contracts, contribute to the spread of customary marriage, which affects the increase in cases related to proving marriage as well as proving parentage, as the civil status interests refrain from registering children born with Through the customary marriage of their fathers, because they did not have a registered contract, which prompted many fathers to resort to the court in order to prove the lineage of their children after confirming this marriage contract. What we saw through the approved ruling as a practical example supported by the study.
