الملخص
تقدم هذه الدراسة مقاربة قانونية لكشف الغموض عن مدى شرعية الاتجاه الحديث نحو خصخصة الحرب من خلال استخدام الشركات العسكرية والأمنية الخاصة، هذه الأخيرة التي بات صعودها كفاعل دولي من غير الدول حاضرا بقوة في مشهد العلاقات الدولية في عالمنا اليوم، الأمر الذي دفعنا الى العرض لخصخصة الحرب كنهج جديد لادارة النزاعات المسلحة، ثم التطرق للتداعيات القانونية، وصولا للتدابير والضمانات التي تمكن من مراقبة عمل الشركات العسكرية والأمنية الخاصة باعتبارها اهم أدوات خصخصة الحرب، واخضاعها لاحكام القانون الدولي الانساني. This study provides a legal approach to unambiguously the legitimacy of the recent trend towards privatizing war through the use of private military and security companies. The latter, whose rise as an international non-State actor has become strongly present in the scene of international relations in our world today, which led us to offer to privatize war as a new approach to the management of armed conflicts, and then address the legal consequences, with the aim of implementing measures and guarantees that enable the work of private military and security companies as the most important tools of privatization of war.
