الطبيعة النوعية الخاصة لقواعد القانون الدولي الإنساني

الملخص
يتمثل جوهر القانون الدولي الإنساني في الحماية التي يوفرها للأشخاص والممتلكات أثناء النزاعات المسلحة، ورغم كونه من أهم فروع القانون الدولي العام إلا انه يحتفظ باستقلاليته واكتفائه بذاته في وجوده القانوني كقانون من نوع خاص يتجه من حيث أغراضه وانشغالاته التي تنصب على حل المشكلات الإنسانية الناجمة عن سائر أوضاع النزاعات المسلحة الدولية وغير الدولية، وهو ما جعلنا نتطرق لهذه الدراسة بهدف بيان الطبيعة النوعية الخاصة لقواعد القانون الدولي الإنساني من خلال العرض للصيغة القانونية الخاصة لقواعده والتي تتجلى من جهة في الصفة الآمرة، ومن جهة أخرى في الصبغة التشريعية للمعاهدات الدولية المكونة لفحواه، ثم التطرق للطابع المطلق والشمولي لقواعده وذلك بالبحث في الطابع المطلق لاتفاقيات القانون الدولي الإنساني، ثم لشمولية وسريان خطابه في مواجهة الكافة، وكل هذا بطرح الإشكال حول ماهية المظاهر المجسدة للطابع النوعي الخاص للقانون الدولي الإنساني؟ وماهية الملامح الأساسية التي يتسم بها من حيث طبيعة وأوصاف قواعده وموضوعاته وأغراضه وآليات تطبيقه ووضعه موضع التنفيذ؟ The essence of international humanitarian law on the protection of persons and property during armed conflicts, despite being one of the most important branches of public international law but maintains his independence and solitude in legal existence as a special kind of law is heading in terms of its purpose and its concerns focused on solving.The humanitarian problems caused by other conditions of international and non-international armed conflicts, which made us get into this study aimed at specific nature manifest for the rules of international humanitarian law through the legal version of the rules, which are reflected in the characteristics and jus .Another in the legislative nature of constituent content of international treaties, and then address the absolute nature and comprehensiveness of its rules by looking at the absolute character of international humanitarian law conventions, and then to the universality and validity of omens speech, asking about what shapes embodied aspects of character The special quality of international humanitarian law?
