الضوابط المقيّدة لحق التصرف المادي لضمان القواعد البيئية والصحية في التهيئات العقارية

الملخص
الملخص: يعالج هذا المقال ضوابط حق التصرف في التهيئات العقارية لضمان تحقق البعد البيئي و الشروط الواجب توفرها لممارسة هذا الحق و الإجراءات المتبعة في تنظيمه، وكذا القيود التي ترد عليه، وكما هو معروف فإن حق الملكية العقارية يمنح للمالك سلطة الاستئثار بالعقار وحده، والتسلط من خلال القدرة على التصرف فيه بِحُرية، ويُرتب على الغير واجب قانوني باحترام هذا الحق وعدم الاعتداء عليه، ما يستوجب توفير الحماية القانونية له ويظهر ذلك من خلال ما يخوله في حق اللجوء إلى القضاء لدفع أي خطر يداهمه عن طريق الدعوى القضائية . غير أن حق التصرف في الملكية العقارية لم يعد مطلقا دون رادع أو مانع بل أصبح يؤدي وظيفة اجتماعية بيئية وصحية في آن واحد، فرضت وضع حدود لهذا الحق، رعاية للمصلحة العامة المقدمة على كل المصالح بشرط ضمانها للأبعاد البيئية والصحية والأمنية للمجتمع ككل. الكلمات المفتاحية: حق التصرف في الملكية العقارية، البعد البيئي، رعاية المصلحة العامة، ضوابط التصرف العقاري . Abstract: This article deals with the controls of the right to dispose of real estate developments to ensure that the environmental dimension and the conditions that are required to exercise this right and the procedures followed in its regulation, as well as the restrictions that are presented to it, are fulfilled, and as is known, the right of real estate property gives the owner the power to monopolize the property alone, and to rule through ability To dispose of it freely, and a third party has a legal duty to respect this right and not to violate it, which necessitates providing him with legal protection, and this appears through what he authorizes in the right to resort to the judiciary to pay any danger to him through the lawsuit. However, the right to dispose of real property is no longer absolute without deterrence or impediment, but rather it performs a social, environmental and health function at the same time.
