دور قوانين البيئة في منع زراعة القنب الهندي The Role Of The Environmental Laws In Preventing The Cannabis Cultivation

الملخص
الملخص: سعى المشرع الجزائري من خلال عدة قوانين إلى القضاء على ظاهرة المخدرات. والتي انتشرت كثيرا في أوساط الشباب؛ سواء بمنع زراعتها أو إنتاجها أو بيعها، وهذا لما قد تسببه من تلوث لكل عناصر البيئة. ويمكن اعتبار قانون البيئة 03/10، والقوانين ذات الصلة. أهم التشريعات التي اهتمت بمحاربة ظاهرة المخدرات، خصوصا زراعة أنواع منها كالقنب الهندي، حماية للإنسان، وكذا وقاية النباتات والأراضي الزراعية والمياه الجوفية. وهذا ما أكدته المادة 4/2 من القانون 03/10:"الوقاية من كل أشكال التلوث والأضرار الملحقة بالبيئة، وذلك بالحفاظ على مكوناتها" والإشكال المطروح، ما هو دور قوانين البيئة في مكافحة زراعة المخدرات.؟ :Abstract The Algerian legislator sought through several laws to eliminate the phenomenon of drugs which has spread widely among young people، whether by preventing its cultivation، production or sale، and this is to what it may cause as pollution to all environment elements. The 03/10 environmental law and the related laws can be considered as the most important legislation that dealt with fighting this phenomenon of drugs، especially the cultivation of varieties such as cannabis، protecting humans as well as plants، agricultural lands and groundwater. This is confirmed by Article 2/4 of the Law 03/10: “Prevention from all forms of pollution and damages caused to the environment in order to preserve its components.” ?
